This website is operated by Brinava LLC. Throughout the site, "we", "us" and "our" refer to Brinava LLC.
We offer this website — including all information, tools and services available through it — on the condition that you accept the terms, conditions, policies and notices set out here.
By visiting our site or purchasing from us, you engage in our service and agree to be bound by these terms, together with the policies referenced within them. They apply to everyone who uses the site: browsers, customers, vendors and anyone contributing content.
Any new features or tools added to the store are also subject to these terms. The current version is always available on this page with the date above, and changes don't apply retroactively to orders already placed.
Our store runs on a third-party e-commerce platform. Your purchase contract is with Brinava LLC.

2. Who can order
You must be at least 18 years old to place an order, or have the consent of a parent or legal guardian.
An account isn't required — guest checkout is available. If you create one, keeping your login details secure is your responsibility, as is activity under the account.
You may not use our products for any illegal or unauthorized purpose, violate any applicable law or regulation, or transmit worms, viruses, malware or any code of a destructive nature.
Where we reasonably believe these terms have been seriously breached, we may suspend or terminate access. Orders already confirmed will still be fulfilled.
3. General conditions
We may refuse service where there's a lawful reason to do so.
Your content may be transferred across various networks and adapted to meet technical requirements. Payment card information is always encrypted in transit and handled by a PCI-DSS compliant processor.
You may not reproduce, duplicate, copy, sell, resell or exploit any portion of the service, or any contact information on the site, without our express written permission.
Section headings are for convenience only and don't affect the meaning of these terms.
4. Accuracy of site information
We make reasonable efforts to keep the information on this site accurate, complete and current, but we can't guarantee that it always is.
Material on the site is provided for general informational purposes and shouldn't be relied on as the sole basis for a decision.
The site may contain historical information, provided for reference only. We may modify the content at any time without an obligation to update every detail.
5. Products, prices and availability
Certain products may be available exclusively online and in limited quantities.
We make every effort to display colors, images and descriptions accurately. Screens vary, so we can't guarantee that your device shows every color exactly. Measurements are approximate unless stated otherwise.
All prices are shown in US dollars. Applicable sales tax is calculated at checkout based on your shipping address, and the total displayed is the total you pay — nothing further is collected on delivery.
Prices, descriptions and availability may change. The price that applies is the one shown when you place your order, as confirmed in your order confirmation. Later changes don't affect orders already accepted.
Obvious pricing and description errors aren't binding on us. Where one affects your order, we'll contact you and you may proceed at the corrected price or cancel that item for a full refund.
We may limit sales to any person, household, region or jurisdiction where permitted by law, and may discontinue a product at any time.
Brinava sells and ships within the United States only.
6. Orders and account information
You agree to provide current, complete and accurate purchase and account information, and to update it promptly — including your email address and payment details — so we can complete your transactions and contact you.
Submitting an order is an offer to purchase. The contract is formed when we confirm that your order has shipped.
We may refuse or cancel an order where a product is unavailable, payment can't be authorized, we've identified a pricing or description error, or we reasonably suspect fraud. We may also limit quantities purchased per person, per household or per order, including orders placed under the same account, payment method, billing address or shipping address, and orders that appear to be placed by dealers, resellers or distributors.
If we change or cancel an order, we'll attempt to notify you using the details provided at checkout. Where payment has been taken and we cancel, we refund in full.
Cancellations: you may cancel free of charge any time before your order ships. Email us with your order number as soon as you can — orders often go to fulfillment within a few hours.
7. Payment
Payment is taken when you place your order, using the methods shown at checkout.
Payments are processed by a PCI-DSS compliant provider, and we don't store full card details. By submitting payment information you confirm you're authorized to use that method.
If a payment is declined or reversed, we may cancel the order.
8. Shipping and delivery
Processing and delivery timeframes are set out in our Shipping Policy, which forms part of these terms.
Risk of loss passes to you on delivery — not when the package is handed to the carrier. If your order arrives damaged or doesn't arrive at all, contact us and we'll open the investigation with the carrier ourselves.
Delivery estimates are estimates. We're not liable for delays caused by carriers, weather or other events outside our control, though we'll help trace a delayed package.
Where we can't ship within the stated timeframe — or within 30 days if no timeframe was given — we'll notify you and you may choose to wait for a revised date or cancel for a full refund.
9. Returns and refunds
Returns are governed by our 30-Day Refund and Return Policy, which forms part of these terms.
If a product arrives damaged, defective or incorrect, contact us within 30 days of delivery with your order number and photographs. You choose a replacement or a full refund, and we cover the return shipping.
This doesn't limit any rights you have under applicable consumer protection law, including implied warranties of merchantability and fitness for a particular purpose where those apply in your state.
10. Optional tools and third-party links
We may provide access to third-party tools that we neither monitor nor control. These are provided "as is" and "as available", without warranties or endorsement, and used entirely at your own risk and discretion.
Review the relevant provider's terms before using such a tool.
Our site may link to third-party websites. We're not responsible for their content, accuracy or practices. Complaints about third-party products go directly to that party.
New services and features introduced through the website will also be subject to these terms.
11. Reviews and submissions
You retain ownership of what you submit. By sending us reviews, comments, photographs, suggestions or other content, you grant us a non-exclusive, royalty-free license to use, edit, publish, distribute and display it in any medium.
We're under no obligation to keep submissions confidential, to compensate you, or to respond.
You confirm that your content is your own or shared with permission, based on genuine experience, and that you've disclosed any compensation or incentive received in connection with a review. It must not infringe anyone's copyright, trademark, privacy or publicity rights, contain unlawful, defamatory or obscene material, or include malicious code.
You may not use a false email address, impersonate another person, or mislead us about the origin of a submission.
We may remove content that breaches these terms.
12. Intellectual property
All content on this site — the Brinava name, logo, product photography, graphics, text and site design — is owned by Brinava LLC or its licensors and protected by US and international intellectual property law.
These terms permit personal, non-commercial use only. Without our written permission you may not reproduce, distribute, modify, republish or commercially exploit any part of it.
13. Prohibited uses
You may use the site for lawful purposes only. You may not use it to violate any law or regulation, to infringe intellectual property rights, to harass, abuse, defame or harm anyone, to submit false or misleading information, to transmit malicious code, to collect or track others' personal information, to spam, phish, scrape or crawl, or to interfere with or circumvent the site's security features.
14. Privacy
Personal information collected through the site is governed by our Privacy Policy.
15. Errors and corrections
The site may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability.
We may correct such errors and change, update or cancel affected orders, including after an order has been placed. Where we cancel for this reason, we refund in full.
16. Site availability
We may modify, suspend or discontinue parts of the service where reasonably necessary. We don't guarantee that access will always be uninterrupted, secure or error-free.
Nothing in this section affects an order we've already accepted.
17. Disclaimer and limitation of liability
Except as expressly stated, the site and all products are provided "as is" and "as available."
To the fullest extent permitted by law, we're not liable for indirect, incidental, punitive, special or consequential damages — including lost profits, lost revenue, lost data or replacement costs — arising from your use of the site or any product purchased through it.
Our total liability arising from any order is limited to the amount you paid for that order.
Nothing in these terms excludes or limits liability for fraud, for personal injury caused by our negligence, or for any liability that cannot legally be excluded. Some states do not allow the exclusion of implied warranties or the limitation of certain damages, so parts of this section may not apply to you.
Our products are supplied for personal and household use. Where it may lawfully be excluded, we're not responsible for business losses.
18. Indemnification
To the extent permitted by law, you agree to indemnify, defend and hold harmless Brinava LLC and its officers, employees, agents, contractors and service providers against reasonable claims, losses and legal costs arising from your breach of these terms, your violation of any law, or your infringement of a third party's rights.
19. Events outside our control
We're not responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, hurricanes, carrier disruption, labor action, technical failures or government action.
Nothing in this section removes statutory rights relating to delayed or failed delivery.
20. Termination
These terms remain in effect while you use the site. You may stop using it at any time.
Where you materially breach these terms, we may suspend or terminate your access. Orders already confirmed will still be fulfilled, and amounts owed up to the termination date remain payable.
Sections covering intellectual property, submissions, disclaimers, limitation of liability, indemnification, severability, governing law and privacy survive termination.
21. Complaints and dispute resolution
If something goes wrong, contact us at support@brinava.com. We respond within one business day and aim to resolve complaints within 14 days.
Please contact us before filing a chargeback with your bank. We resolve most issues directly and considerably faster — a bank dispute typically takes 30 to 90 days. That doesn't affect your right to file one if you need to.
Nothing here prevents you from bringing a claim in small claims court, or from exercising any right available under the consumer protection laws of your own state.
22. General
If any provision of these terms is found unenforceable, the remainder continues in full effect. Our failure to enforce a provision doesn't waive our right to enforce it later.
These terms, together with our Refund Policy, Shipping Policy and Privacy Policy, form the entire agreement between us and supersede any prior understanding.
Ambiguities won't be construed against the drafting party.
Assignment: you may not transfer or assign these terms without our written consent. We may transfer or assign them without notice.
23. Governing law and jurisdiction
These terms, and any contract made through our website, are governed by the laws of the State of Florida and applicable federal law of the United States, without regard to conflict-of-law principles.
Where a dispute can't be resolved directly, it will be brought before the state or federal courts located in Orange County, Florida.
Nothing in these terms limits any mandatory consumer protection available to you under the law of your own state, including the Florida Deceptive and Unfair Trade Practices Act.
